Regulamin świadczenia usług drogą elektroniczną w serwisie freshly.cc. Opisuje, co dokładnie robimy, ile kosztuje licencja, jak działa panel i co przysługuje Ci, gdy coś pójdzie nie tak.
§1Sprzedawca
Usługi serwisu freshly.cc świadczy Jakub Kozłowski, ul. Pułkowa 11A, 15-101 Białystok, w ramach działalności nierejestrowanej zgodnie z art. 5 ust. 1 ustawy z dnia 6 marca 2018 r. Prawo przedsiębiorców. Sprzedawca nie posiada statusu przedsiębiorcy, nie podlega wpisowi do CEIDG i nie posiada numerów NIP ani REGON.
Sprzedawca korzysta ze zwolnienia podmiotowego z podatku VAT i nie wystawia faktur VAT. Na życzenie Kupującego wystawia rachunek.

§2Definicje
- Sprzedawca
- Jakub Kozłowski, prowadzący serwis freshly.cc na zasadach opisanych w §1.
- Kupujący
- Osoba składająca zamówienie. Konsumentem jest Kupujący będący osobą fizyczną, która zawiera umowę w celu niezwiązanym bezpośrednio z jej działalnością gospodarczą lub zawodową.
- Strona
- Strona internetowa wykonana przez Sprzedawcę na zamówienie Kupującego.
- Licencja
- Odpłatny, czasowy dostęp do panelu i API freshly.cc, w ramach którego Strona jest utrzymywana i wyświetlana odwiedzającym.
- Panel
- Aplikacja pod adresem freshly.cc/panel, w której Kupujący zarządza treścią Strony i Licencją.
- Kod aktywacyjny
- Jednorazowy kod, który przypisuje Stronę do konta Kupującego w Panelu.
- Treść cyfrowa
- Dane wytwarzane i dostarczane w postaci cyfrowej, w tym gotowa Strona i jej pliki.
- Regulamin
- Niniejszy dokument, będący regulaminem świadczenia usług drogą elektroniczną.
§3Zakres usługi
freshly.cc projektuje i wdraża strony internetowe oraz udziela Licencji na panel i API, na których te strony działają. Realizujemy trzy rodzaje zamówień:
- sklepy dla serwerów Minecraft — strony z itemshopem opartym o API serwisu VIshop,
- sklepy internetowe — strony sprzedażowe podpięte pod platformę Shopify,
- strony firmowe — wizytówki, portfolia i strony informacyjne bez sprzedaży.
Usługa składa się z dwóch części: jednorazowego wykonania Strony, wycenianego indywidualnie, oraz Licencji, opłacanej okresowo według cennika z §6. Pierwsze 30 dni Licencji jest wliczone w cenę wykonania Strony.
Zamówienie może obejmować dodatki: Administracja (ekipa serwera), Rankingi (wyniki graczy prosto z serwera), Maile (wygląd wiadomości po zakupie) oraz Newsletter (wysyłka do klientów sklepu). Dodatki wyceniane są razem ze Stroną i włącza je Sprzedawca. Dokładny zakres każdego zamówienia ustalany jest przed rozpoczęciem realizacji i potwierdzany Kupującemu.
§4Wymagania techniczne
Do korzystania z usługi wystarczy urządzenie z dostępem do Internetu, aktualna przeglądarka z włączoną obsługą JavaScript i plików cookies (Chrome, Firefox, Safari, Edge w wersji wspieranej przez producenta) oraz czynny adres e-mail.
Poszczególne rodzaje stron wymagają dodatkowo:
- itemshop — aktywnego planu Premium w serwisie vishop.pl,
- sklep internetowy — aktywnego planu w serwisie Shopify,
- dodatek Rankingi — serwera Minecraft z PlaceholderAPI, na którym Kupujący zainstaluje wtyczkę FreshlyTopki udostępnianą w Panelu,
- własny adres — domeny zarejestrowanej przez Kupującego u dowolnego rejestratora.
Kupujący nie potrzebuje własnego serwera ani hostingu. Korzystanie z Internetu wiąże się z ryzykiem typowym dla sieci publicznej (złośliwe oprogramowanie, przechwycenie transmisji), dlatego połączenie z serwisem jest szyfrowane (HTTPS).
§5Zawarcie umowy i składanie zamówienia
Zamówienie składa się w następujących krokach:
- Kupujący kontaktuje się przez formularz na stronie, e-mail albo Discord i opisuje zakres.
- Sprzedawca przedstawia wycenę Strony oraz termin realizacji.
- Kupujący akceptuje wycenę i niniejszy Regulamin.
- Kupujący opłaca zamówienie.
Umowa zostaje zawarta w chwili potwierdzenia przyjęcia zamówienia przez Sprzedawcę, przesłanego Kupującemu e-mailem albo na Discordzie. Potwierdzenie zawiera zakres, cenę i termin realizacji. Zamówienie złożone e-mailem jest tak samo ważne jak złożone przez formularz albo na Discordzie.
Zamówienie składa Kupujący we własnym imieniu. Płatność w imieniu innej osoby bez jej wiedzy stanowi naruszenie Regulaminu; w takim przypadku Sprzedawca realizuje zamówienie na rzecz faktycznego Kupującego.
Sprzedawca nie wymaga ukończenia 18 lat, aby złożyć zamówienie. Kupujący, który nie jest pełnoletni, składa je i opłaca za wiedzą oraz zgodą rodzica lub opiekuna prawnego, a na żądanie Sprzedawcy przedstawia jej potwierdzenie. Ustalenia dotyczące Strony Sprzedawca prowadzi wprost z Kupującym.
§6Ceny i płatności
Wycena Strony jest indywidualna i zależy od zakresu prac. Ceny zaczynają się od 100 zł za wykonanie. Wszystkie ceny podawane są w złotych polskich i są cenami końcowymi. Sprzedawca korzysta ze zwolnienia z VAT, więc do podanych kwot nie doliczają się żadne podatki ani dodatkowe opłaty.
Licencja rozliczana jest w jednym z trzech okresów:

Licencję przedłużasz w Panelu, w zakładce Licencja. Opłacony okres dolicza się do bieżącego terminu, więc przedłużenie przed końcem niczego nie zabiera. O zbliżającym się końcu Licencji Sprzedawca przypomina e-mailem na tydzień przed terminem, a w dniu wygaśnięcia informuje o zawieszeniu Strony. Zmiana cennika nie dotyczy okresów już opłaconych.
Płatności obsługuje operator SimPay. Listę dostępnych metod wraz z ceną końcową widzisz w ostatnim kroku zamówienia. Sprzedawca nie przechowuje danych kart ani danych do logowania do bankowości. Obsługuje je wyłącznie operator płatności.
O ile nie ustalono inaczej, wykonanie Strony opłaca się z góry, przed rozpoczęciem realizacji. Termin płatności wynosi 7 dni od potwierdzenia zamówienia; po jego bezskutecznym upływie zamówienie uznaje się za niezłożone.
Brak opłaty za kolejny okres Licencji skutkuje zawieszeniem Strony.
Po upływie opłaconego okresu Strona przestaje się wyświetlać odwiedzającym, a pod jej adresem pojawia się plansza informacyjna. Zawieszenie nie kasuje żadnych danych: ustawienia, treści, dodatki i statystyki pozostają nienaruszone, a dostęp do Panelu działa dalej. Po zaksięgowaniu opłaty Strona wraca automatycznie, bez potrzeby ponownego wdrożenia. Sprzedawca przechowuje dane zawieszonej Strony przez co najmniej 90 dni od końca opłaconego okresu; po tym czasie może je usunąć po uprzednim poinformowaniu Kupującego e-mailem.
§7Dostarczenie treści cyfrowej
Usługa ma charakter w pełni cyfrowy. Nie następuje żadna wysyłka fizyczna i nie powstają koszty dostawy.
Gotowa Strona udostępniana jest pod adresem technicznym, a po podpięciu domeny — pod adresem Kupującego. Razem ze Stroną Kupujący otrzymuje Kod aktywacyjny, którym przypisuje ją do swojego konta w Panelu.
Kod źródłowy Strony nie jest udostępniany, chyba że strony ustaliły inaczej przed zawarciem umowy.
§8Termin realizacji
Termin realizacji ustalany jest indywidualnie i podawany Kupującemu przed zawarciem umowy. Termin biegnie od dnia zaksięgowania płatności oraz przekazania przez Kupującego wszystkich materiałów potrzebnych do pracy.
Sprzedawca nie ponosi odpowiedzialności za opóźnienie wynikające z przyczyn od niego niezależnych: awarii lub zmian po stronie usług zewnętrznych (VIshop, Shopify, Cloudflare, dostawcy poczty), siły wyższej oraz przerw w dostępie do Internetu. O każdym opóźnieniu Sprzedawca informuje Kupującego i wskazuje nowy termin.
§9Prawo odstąpienia od umowy
Konsumentowi przysługuje prawo odstąpienia od umowy w terminie 14 dni od jej zawarcia, bez podania przyczyny i bez ponoszenia kosztów. Oświadczenie wystarczy przesłać na adres support@freshly.cc, zwykłą wiadomością z numerem zamówienia. Prawo to przysługuje dopóki nie zażądasz natychmiastowego rozpoczęcia usługi w sposób opisany w §10.
Sprzedawca zwraca całość otrzymanej płatności niezwłocznie, nie później niż w terminie 14 dni od otrzymania oświadczenia, tym samym sposobem, którym płatność została dokonana.
Utrata prawa odstąpienia. Zgodnie z art. 38 pkt 13 ustawy o prawach konsumenta prawo odstąpienia nie przysługuje po spełnieniu świadczenia, jeżeli Konsument przed jego rozpoczęciem wyraził na to wyraźną zgodę i przyjął do wiadomości utratę tego prawa. Dotyczy to obu części usługi: Licencji, która rusza natychmiast po opłaceniu, oraz wykonania Strony, przy którym prace ruszają od razu po potwierdzeniu zamówienia.
Jeżeli Konsument odstąpi od umowy po rozpoczęciu prac, na które wyraził zgodę, zapłaci za świadczenie spełnione do chwili odstąpienia, proporcjonalnie do zakresu wykonanych prac.
§10Zgody przy zakupie licencji i strony
Licencję uruchamiamy natychmiast po zaksięgowaniu płatności, a prace nad zamówioną Stroną zaczynamy zaraz po potwierdzeniu zamówienia. W obu wypadkach świadczenie zostaje spełnione od razu, więc przed startem odbieramy od Kupującego wyraźne oświadczenie. Bez niego usługa nie rusza.
Licencja — dwa pola zaznaczane w Panelu przed płatnością: „Zapoznałem się z regulaminem i polityką prywatności freshly.cc i akceptuję ich treść." oraz „Chcę, żeby licencja ruszyła od razu po opłaceniu. Wiem, że przez to tracę prawo odstąpienia od umowy, a opłata za rozpoczęty okres nie podlega zwrotowi."
Wykonanie Strony — oświadczenie potwierdzane e-mailem albo na Discordzie przed rozpoczęciem prac: „Żądam rozpoczęcia realizacji przed upływem 14 dni i przyjmuję do wiadomości, że po wykonaniu strony tracę prawo odstąpienia od umowy."
Treść i datę oświadczenia zapisujemy razem z zamówieniem i przechowujemy na wypadek sporu. Bez złożenia oświadczenia Sprzedawca nie rozpoczyna świadczenia przed upływem 14 dni od zawarcia umowy.
§11Reklamacje
Reklamację zgłaszasz na adres support@freshly.cc lub przez Discord dc.freshly.cc. Zgłoszenie powinno zawierać:
- opis nieprawidłowości,
- adres Strony, której dotyczy,
- oczekiwany sposób załatwienia sprawy.
Sprzedawca rozpatruje reklamację w terminie 14 dni od jej otrzymania i informuje Kupującego o wyniku na adres, z którego wpłynęło zgłoszenie. Brak odpowiedzi w tym terminie oznacza uznanie reklamacji.
Reklamacja dotyczy wad usługi: Strony niezgodnej z ustaleniami, niedziałających funkcji albo niedziałającej Licencji (Panelu, API lub samej Strony). Sprzedawca odpowiada wobec Konsumenta za brak zgodności treści cyfrowej z umową na zasadach rozdziału 5b ustawy o prawach konsumenta i doprowadza usługę do stanu zgodnego z umową.
Reklamacją nie jest zmiana zdania po prawidłowo wykonanej usłudze. Poprawnie dostarczona Strona oraz uruchomiona i działająca Licencja nie podlegają zwrotowi środków. Od tego jest prawo odstąpienia z §9, z którego można skorzystać przed rozpoczęciem świadczenia.
Błędy w wykonanej Stronie zgłaszaj możliwie szybko. Poprawki błędów wykonujemy w ramach Licencji; zmiany wykraczające poza pierwotny zakres wyceniane są osobno.
§12Licencja i dostępność
W ramach Licencji Kupujący otrzymuje:
- dostęp do Panelu i API freshly.cc dla siebie i dodanych przez siebie pracowników,
- utrzymanie Strony na infrastrukturze Cloudflare wraz z ochroną przed atakami DDoS,
- certyfikat SSL i podpięcie własnej domeny bez dodatkowych opłat — samą domenę Kupujący utrzymuje u swojego rejestratora,
- aktualizacje i poprawki błędów Strony.
Licencja jest niewyłączna i dotyczy jednej Strony. Na inne konto przechodzi wyłącznie razem ze Stroną, przez przekazanie opisane w §14. Nie obejmuje prawa do kodu źródłowego ani do korzystania z API poza Stroną, dla której została udzielona.
Sprzedawca dokłada starań o możliwie najwyższą dostępność, nie gwarantuje jednak nieprzerwanego działania. Możliwe są przerwy techniczne oraz awarie po stronie dostawców.
Nieopłacenie Licencji skutkuje zawieszeniem Strony na zasadach z §6. Jeżeli Sprzedawca zawiesi Stronę z innej przyczyny, na przykład naruszenia §14, bieg Licencji zostaje wstrzymany na czas zawieszenia i po wznowieniu Kupujący ma tyle dni, ile zostało mu w chwili zawieszenia.
§13Integracje zewnętrzne
Strony z itemshopem korzystają z API serwisu VIshop. Do ich działania wymagany jest aktywny plan Premium na vishop.pl, wykupywany przez Kupującego osobno. Produkty, ceny, vouchery, ogłoszenia i cel miesięczny widoczne na Stronie pochodzą z VIshop i tam są zarządzane.
Sklepy internetowe korzystają z Shopify i wymagają aktywnego planu w tym serwisie, również wykupywanego osobno.
Płatności klientów w sklepie realizuje odpowiednio VIshop albo Shopify, na podstawie własnego regulaminu. freshly.cc nie pośredniczy w tych płatnościach, nie przyjmuje ich i nie przechowuje danych płatniczych kupujących.
Dodatek Rankingi korzysta z wtyczki FreshlyTopki zainstalowanej na serwerze Kupującego. Wtyczka przesyła do freshly.cc wyłącznie nicki graczy i wartości z placeholderów wskazanych w Panelu.
§14Panel klienta i konto
Konto w Panelu zakładasz podając nazwę, adres e-mail i hasło oraz akceptując Regulamin i Politykę prywatności. Przy logowaniu z nowego miejsca, przy zmianie adresu e-mail oraz zawsze, gdy włączysz potwierdzanie kodem, wysyłamy na Twój adres pięciocyfrowy kod, który wpisujesz obok hasła. Kod jest ważny piętnaście minut.
Stronę przypisujesz do konta Kodem aktywacyjnym. Dopóki żadna Strona nie jest aktywowana, konto pokazuje wyłącznie ekran aktywacji. Właściciel może dodać pracowników z dostępem do wybranych zakładek, w tym do Licencji i płatności, oraz przekazać Stronę na inne konto kodem przekazania. Przekazanie przenosi Licencję i dodatki, a dotychczasowi pracownicy tracą dostęp.
Kupujący odpowiada za bezpieczeństwo swojego konta i za działania osób, którym udostępnił do niego dostęp. Konto możesz w każdej chwili usunąć w Panelu albo pisząc na support@freshly.cc.
Zabronione jest dostarczanie treści bezprawnych, w szczególności naruszających prawa osób trzecich, oraz korzystanie z Panelu lub API w sposób zakłócający ich działanie.
§15Dane osobowe
Administratorem danych osobowych jest Jakub Kozłowski, ul. Pułkowa 11A, 15-101 Białystok, kontakt: support@freshly.cc. Szczegółowe zasady przetwarzania opisuje Polityka prywatności.
Podanie danych jest dobrowolne, ale niezbędne do zawarcia i wykonania umowy. Przysługuje Ci prawo dostępu do danych, ich sprostowania, usunięcia, ograniczenia przetwarzania, przenoszenia oraz wniesienia sprzeciwu, a także skargi do Prezesa Urzędu Ochrony Danych Osobowych.
§16Zmiany regulaminu
Sprzedawca może zmienić Regulamin z ważnych przyczyn: zmiany przepisów prawa, zmiany zakresu lub sposobu świadczenia usług, względów bezpieczeństwa lub zmian technicznych.
O zmianie Sprzedawca informuje na stronie oraz e-mailem co najmniej 14 dni przed jej wejściem w życie. Do umów zawartych przed zmianą stosuje się Regulamin w brzmieniu z dnia zawarcia umowy.
§17Postanowienia końcowe
W sprawach nieuregulowanych stosuje się przepisy prawa polskiego, w szczególności Kodeksu cywilnego, ustawy o prawach konsumenta oraz ustawy o świadczeniu usług drogą elektroniczną.
Żadne postanowienie Regulaminu nie ogranicza praw Konsumenta wynikających z bezwzględnie obowiązujących przepisów. W razie sprzeczności pierwszeństwo mają przepisy prawa.
Regulamin jest dostępny nieodpłatnie pod adresem freshly.cc/regulamin.html w formie umożliwiającej jego pobranie, odtworzenie i utrwalenie.

Terms of service
The terms for electronic services at freshly.cc. What exactly we do, what the licence costs, how the panel works and what you are entitled to when something goes wrong.
§1Seller
The freshly.cc services are provided by Jakub Kozłowski, ul. Pułkowa 11A, 15-101 Białystok, Poland, as an unregistered activity under Article 5(1) of the Polish Entrepreneurs' Law of 6 March 2018. The Seller is not an entrepreneur, is not entered in the CEIDG register and has no NIP or REGON number.
The Seller is exempt from VAT and does not issue VAT invoices. A bill is issued at the Buyer's request.

§2Definitions
- Seller
- Jakub Kozłowski, who runs freshly.cc on the terms described in §1.
- Buyer
- The person placing an order. A Consumer is a Buyer who is a natural person entering into the contract for purposes not directly related to their business or profession.
- Site
- A website made by the Seller to the Buyer's order.
- Licence
- Paid, time-limited access to the freshly.cc panel and API, under which the Site is maintained and shown to visitors.
- Panel
- The application at freshly.cc/panel where the Buyer manages the Site's content and the Licence.
- Activation code
- A one-time code that assigns the Site to the Buyer's account in the Panel.
- Digital content
- Data produced and supplied in digital form, including the finished Site and its files.
- Terms
- This document, being the terms for providing services electronically.
§3Scope of the service
freshly.cc designs and deploys websites and grants a Licence to the panel and API on which these sites run. We handle three kinds of orders:
- shops for Minecraft servers — sites with an item shop based on the VIshop API,
- online shops — sales sites connected to the Shopify platform,
- company sites — business cards, portfolios and information sites without sales.
The service has two parts: a one-off build of the Site, priced individually, and the Licence, paid periodically according to the price list in §6. The first 30 days of the Licence are included in the price of the Site.
An order may include add-ons: Administration (the server team), Rankings (player results straight from the server), Emails (the look of messages after a purchase) and Newsletter (mailing to shop customers). Add-ons are priced together with the Site and switched on by the Seller. The exact scope of each order is agreed before work starts and confirmed to the Buyer.
§4Technical requirements
All you need is a device with Internet access, an up-to-date browser with JavaScript and cookies enabled (Chrome, Firefox, Safari or Edge in a version supported by its maker) and a working e-mail address.
Some kinds of sites also require:
- item shop — an active Premium plan at vishop.pl,
- online shop — an active Shopify plan,
- Rankings add-on — a Minecraft server with PlaceholderAPI, on which the Buyer installs the FreshlyTopki plugin available in the Panel,
- own address — a domain registered by the Buyer with any registrar.
The Buyer does not need their own server or hosting. Using the Internet carries the risks typical of a public network (malware, interception of transmission), which is why the connection to the service is encrypted (HTTPS).
§5Conclusion of the contract and placing an order
An order is placed in the following steps:
- The Buyer gets in touch through the form on the site, by e-mail or on Discord and describes the scope.
- The Seller presents a quote for the Site and a delivery date.
- The Buyer accepts the quote and these Terms.
- The Buyer pays for the order.
The contract is concluded when the Seller confirms acceptance of the order, sent to the Buyer by e-mail or on Discord. The confirmation states the scope, price and delivery date. An order placed by e-mail is just as valid as one placed through the form or on Discord.
The Buyer places the order in their own name. Paying on behalf of another person without their knowledge breaches the Terms; in such a case the Seller fulfils the order for the actual Buyer.
The Seller does not require the Buyer to be 18 to place an order. A Buyer who is a minor places and pays for it with the knowledge and consent of a parent or legal guardian and, at the Seller's request, provides confirmation of that consent. The Seller agrees the details of the Site directly with the Buyer.
§6Prices and payments
The quote for a Site is individual and depends on the scope of work. Prices start at 100 PLN for the build. All prices are given in Polish złoty and are final prices. The Seller is VAT exempt, so no taxes or extra fees are added to the amounts given.
The Licence is billed for one of three periods:

You extend the Licence in the Panel, in the Licence tab. The paid period is added to the current end date, so extending before the end takes nothing away. The Seller reminds you by e-mail a week before the Licence ends and, on the day it expires, informs you that the Site has been suspended. A change of the price list does not apply to periods already paid.
Payments are handled by the operator SimPay. You see the list of available methods together with the final price in the last step of the order. The Seller does not store card data or online banking login details. Only the payment operator handles them.
Unless agreed otherwise, the Site build is paid in advance, before work starts. The payment deadline is 7 days from the order confirmation; if it passes without payment, the order is deemed not placed.
Not paying for the next Licence period results in suspension of the Site.
Once the paid period ends, the Site is no longer shown to visitors and an information screen appears at its address. Suspension deletes no data: settings, content, add-ons and statistics stay intact, and the Panel keeps working. Once the payment is booked, the Site comes back automatically, with no need to deploy it again. The Seller keeps the data of a suspended Site for at least 90 days from the end of the paid period; after that it may delete it after informing the Buyer by e-mail.
§7Delivery of digital content
The service is fully digital. Nothing is shipped physically and there are no delivery costs.
The finished Site is made available at a technical address and, once a domain is connected, at the Buyer's address. Together with the Site the Buyer receives an Activation code with which they assign it to their account in the Panel.
The Site's source code is not provided unless the parties agreed otherwise before concluding the contract.
§8Delivery date
The delivery date is agreed individually and given to the Buyer before the contract is concluded. It runs from the day the payment is booked and the Buyer has provided all materials needed for the work.
The Seller is not liable for delays caused by reasons beyond its control: failures or changes on the side of external services (VIshop, Shopify, Cloudflare, e-mail provider), force majeure and Internet outages. The Seller informs the Buyer of every delay and gives a new date.
§9Right of withdrawal
A Consumer has the right to withdraw from the contract within 14 days of its conclusion, without giving a reason and without any cost. It is enough to send a statement to support@freshly.cc as an ordinary message with the order number. This right applies until you request the service to start immediately as described in §10.
The Seller refunds the full payment received without delay, no later than 14 days from receiving the statement, using the same method with which the payment was made.
Loss of the right of withdrawal. Under Article 38(13) of the Polish Consumer Rights Act, the right of withdrawal does not apply once the service has been performed if the Consumer expressly agreed to this before it started and acknowledged the loss of that right. This covers both parts of the service: the Licence, which starts immediately after payment, and the Site build, where work starts right after the order is confirmed.
If a Consumer withdraws from the contract after work they agreed to has started, they pay for the service performed up to the moment of withdrawal, in proportion to the work done.
§10Consents when buying a licence or a site
We start the Licence immediately after the payment is booked, and we begin work on the ordered Site right after the order is confirmed. In both cases the service is performed at once, so before starting we collect an express statement from the Buyer. Without it the service does not start.
Licence — two boxes ticked in the Panel before payment: “I have read the terms and the privacy policy of freshly.cc and accept them.” and “I want the licence to start right after payment. I understand that I lose the right of withdrawal and a started period is not refundable.”
Site build — a statement confirmed by e-mail or on Discord before work starts: “I request that work begin before the 14 days have passed and I acknowledge that once the site is finished I lose the right to withdraw from the contract.”
We record the content and date of the statement together with the order and keep it in case of a dispute. Without the statement the Seller does not start the service before 14 days have passed since the contract was concluded.
§11Complaints
Send complaints to support@freshly.cc or through Discord dc.freshly.cc. A complaint should contain:
- a description of the problem,
- the address of the Site it concerns,
- how you would like it resolved.
The Seller handles a complaint within 14 days of receiving it and informs the Buyer of the outcome at the address the complaint came from. No reply within that time means the complaint is accepted.
A complaint concerns defects of the service: a Site that does not match what was agreed, features that do not work or a Licence that does not work (the Panel, the API or the Site itself). The Seller is liable to the Consumer for any lack of conformity of digital content with the contract under chapter 5b of the Polish Consumer Rights Act and brings the service into conformity with the contract.
Changing your mind after a correctly performed service is not a complaint. A correctly delivered Site and a started, working Licence are not refundable. That is what the right of withdrawal in §9 is for, which can be used before the service starts.
Report bugs in the finished Site as soon as you can. We fix bugs as part of the Licence; changes going beyond the original scope are priced separately.
§12Licence and availability
Under the Licence the Buyer receives:
- access to the freshly.cc Panel and API for themselves and the staff they add,
- hosting of the Site on Cloudflare infrastructure with protection against DDoS attacks,
- an SSL certificate and connection of their own domain at no extra cost — the Buyer keeps the domain itself with their registrar,
- updates and bug fixes for the Site.
The Licence is non-exclusive and covers one Site. It passes to another account only together with the Site, through the hand-over described in §14. It does not include the right to the source code or to use the API outside the Site it was granted for.
The Seller makes every effort to keep availability as high as possible but does not guarantee uninterrupted operation. Technical breaks and failures on the side of providers are possible.
Not paying for the Licence results in suspension of the Site under §6. If the Seller suspends the Site for another reason, for example a breach of §14, the Licence is paused for the time of the suspension and after it is lifted the Buyer has as many days as they had at the moment of suspension.
§13External integrations
Sites with an item shop use the VIshop API. They require an active Premium plan at vishop.pl, bought separately by the Buyer. Products, prices, vouchers, announcements and the monthly goal shown on the Site come from VIshop and are managed there.
Online shops use Shopify and require an active plan on that service, also bought separately.
Customer payments in the shop are handled by VIshop or Shopify respectively, under their own terms. freshly.cc does not act as an intermediary in these payments, does not receive them and does not store buyers' payment data.
The Rankings add-on uses the FreshlyTopki plugin installed on the Buyer's server. The plugin sends freshly.cc only player nicknames and the values of the placeholders set in the Panel.
§14Customer panel and account
You create a Panel account by giving a name, an e-mail address and a password and by accepting these Terms and the Privacy policy. When you sign in from a new place, when you change your e-mail address and whenever you turn on code confirmation, we send a five-digit code to your address, which you enter next to your password. The code is valid for fifteen minutes.
You assign a Site to your account with an Activation code. Until a Site is activated the account only shows the activation screen. The owner can add staff with access to selected tabs, including the Licence and payments, and hand the Site over to another account with a hand-over code. The hand-over moves the Licence and add-ons, and the existing staff lose access.
The Buyer is responsible for the security of their account and for the actions of people they gave access to. You can delete the account at any time in the Panel or by writing to support@freshly.cc.
It is forbidden to supply unlawful content, in particular content infringing the rights of third parties, and to use the Panel or API in a way that disrupts their operation.
§15Personal data
The controller of personal data is Jakub Kozłowski, ul. Pułkowa 11A, 15-101 Białystok, Poland, contact: support@freshly.cc. The detailed rules of processing are described in the Privacy policy.
Providing data is voluntary but necessary to conclude and perform the contract. You have the right to access your data, rectify it, erase it, restrict its processing, port it and object, as well as to lodge a complaint with the President of the Polish Personal Data Protection Office.
§16Changes to the terms
The Seller may change the Terms for important reasons: changes in the law, changes in the scope or manner of providing services, security reasons or technical changes.
The Seller announces a change on the site and by e-mail at least 14 days before it takes effect. Contracts concluded before the change are governed by the Terms as worded on the day the contract was concluded.
§17Final provisions
Matters not covered here are governed by Polish law, in particular the Civil Code, the Consumer Rights Act and the Act on Providing Services by Electronic Means.
No provision of the Terms limits the Consumer's rights under mandatory provisions of law. In case of conflict, the provisions of law prevail.
